Terms & Conditions

These terms are the agreement between you and MedikZo. They explain what our platform does, what it does not do, and the rules that apply when you use it to request a doctor’s appointment.

01 Who We Are & What These Terms Cover

MedikZo is a healthcare appointment booking platform operated by Helixova Solutions Private Limited, a company incorporated in India with its registered address at Dinhata Road, Coochbehar – 736101, West Bengal, India (“MedikZo”, “we”, “us”, “our”).

These Terms & Conditions (“Terms”) govern your access to and use of medikzo.com and the MedikZo mobile application (together, the “Platform”). By creating an account, requesting an appointment, or otherwise using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

These Terms should be read together with our Privacy Policy, which explains how we handle your personal data, and our Refund Policy, which forms part of these Terms.

In plain terms: we help you find a doctor and we get your appointment confirmed with the clinic by a real person on our team. We are not the doctor, the clinic, or the provider of your treatment. The medical care itself is entirely between you and the clinic you visit.

02 Medical Disclaimer

This section is important. Please read it carefully.

03 Eligibility

To use the Platform you must be at least 18 years of age and legally capable of entering into a binding contract under the Indian Contract Act, 1872.

You may add family members – including minors – as additional profiles under your account and request appointments on their behalf. By doing so you confirm that you are the parent or legal guardian of any minor, or are otherwise authorised by the person concerned, and that you have their consent to share their information with us and with the clinic.

The Platform is intended for use in India and currently serves Coochbehar, Dinhata, Alipurduar, Mathabhanga, Falakata and Tufanganj.

04 Your Account

You may ask us to delete your account and associated data at any time through our Delete My Data page, subject to records we are required by law to retain.

05 How Booking Works

Every appointment on MedikZo passes through a human being on our team. Understanding the two stages below matters, because your cancellation and refund rights depend on which stage your appointment has reached.

Stage What It Means What You Can Do
Requested You have submitted an appointment request in the app. The slot is not yet secured. A MedikZo Patient Coordinator is contacting the clinic to arrange it. Cancel freely, at no charge. Any amount paid is refunded in full.
Confirmed A MedikZo Patient Coordinator has secured the slot with the clinic and notified you by call and/or SMS. The clinic has reserved time for you. You are expected to attend. Cancellation by you does not attract a refund – see Section 08.

An appointment request is an offer to book, not a confirmed booking. We do not guarantee that any particular doctor, date, or time will be available, and a request may not be fulfilled – for example if the doctor’s schedule has changed or the clinic is closed. Where a request cannot be fulfilled, our coordinator will tell you and, where possible, offer an alternative.

Appointment requests are processed during our working hours. Requests submitted outside those hours are taken up the next working day.

06 Call Recording & SMS Consent

By creating an account and submitting an appointment request, you agree that:

You may withdraw this consent at any time by writing to contact@medikzo.com. Because coordinator calls are how appointments get confirmed, withdrawing consent means we can no longer provide the appointment confirmation service to you.

07 Attending, Cancelling & No-Shows

When a clinic confirms a slot for you, it sets aside a doctor’s time that another patient could have used. We ask you to treat that seriously.

Cancelling a confirmed appointment with us does not cancel any separate obligation you may have agreed directly with the clinic.

08 Fees, Payments & Refunds

The amount payable for a booking is shown in the app before you confirm payment. You agree to pay it through the payment methods we make available, and payments are processed by our third-party payment gateway – MedikZo does not store your card or bank details.

Consultation fees shown on doctor and clinic pages are the amounts last confirmed with the clinic and are indicative. The amount a clinic actually charges is set by the clinic and may differ – for example for a follow-up visit, a procedure, or additional tests. Any payment you make at the clinic’s counter is a transaction between you and that clinic, and is not covered by our Refund Policy.

Refunds of amounts paid to MedikZo are governed by our Refund Policy. In summary:

The Refund Policy governs. Section 08 is a summary for convenience. The full rules, including how and when money is returned, are in the Refund Policy, which is incorporated into these Terms by reference. Where this summary and the Refund Policy differ, the Refund Policy applies.

09 Listed Information & Accuracy

Doctor and clinic details on the Platform – names, qualifications, specializations, fees, timings, addresses, and photographs – are supplied by the doctors and clinics themselves or collected by our team, and are confirmed with them periodically. Each doctor and clinic page shows when its information was last confirmed. You can read how this works on our data accuracy page.

Despite those efforts, listings may become outdated or contain errors. The Platform and its content are provided on an “as is” and “as available” basis, and we do not warrant that listed information is complete, accurate, or current at every moment. Where information matters to your decision, confirm it with our coordinator or with the clinic.

If you spot something wrong, please use the “Report incorrect info” link on the relevant doctor or clinic page, or write to contact@medikzo.com. We investigate reports and correct or remove information as required.

We may add, change, or remove listings, features, or parts of the Platform at any time, and may discontinue the Platform in whole or in part, without liability to you.

10 Acceptable Use

11 Intellectual Property

The MedikZo name and logo, the Platform’s design, text, graphics, software, and the compilation and arrangement of its content are owned by Helixova Solutions Private Limited or its licensors, and are protected by Indian and international intellectual property laws.

You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to use the Platform for the purpose of finding doctors and clinics and requesting appointments for yourself and your family. You may not copy, modify, distribute, reverse-engineer, create derivative works from, or create a competing service using any part of the Platform.

Photographs and trade marks of doctors and clinics remain the property of their respective owners and are published with their permission.

Where you submit content to us – a profile photo, appointment notes, feedback, or an information report – you retain ownership of it and grant us a licence to use it to operate and improve the Platform. You confirm you have the right to submit it.

12 Limitation of Liability

To the maximum extent permitted by law:

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including under the Consumer Protection Act, 2019.

13 Indemnity

You agree to indemnify and hold harmless Helixova Solutions Private Limited, its directors, officers, employees, and coordinators against any claim, demand, loss, liability, or expense (including reasonable legal costs) arising out of your breach of these Terms, your misuse of the Platform, information you supply that is false or infringes someone else’s rights, or any appointment you request on another person’s behalf without their authorisation.

14 Suspension & Termination

You may stop using the Platform at any time and may request deletion of your account through our Delete My Data page.

We may limit, suspend, or terminate your access – with notice where practicable, and immediately where the circumstances require it – if you breach these Terms, if you repeatedly fail to attend confirmed appointments, if you abuse our coordinators or a clinic, if we reasonably suspect fraud or unlawful use, or if we are required to do so by law.

On termination, the licence in Section 11 ends. Sections 02, 08, 11, 12, 13, 16, and any other provision intended to survive, continue to apply. Data retention after termination is governed by our Privacy Policy.

15 Changes to These Terms

We may update these Terms from time to time – for example when we add features, introduce fees, or respond to a change in the law. When we make material changes we will notify you through the app or by SMS at least 7 days before they take effect, and will update the “Effective” date at the top of this page.

Continued use of the Platform after the effective date of a change means you accept the revised Terms. If you do not accept them, please stop using the Platform and, if you wish, request deletion of your account. Previous versions are available on written request to contact@medikzo.com.

16 Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of India.

The courts at Coochbehar, West Bengal have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your use of the Platform, subject to any right you have as a consumer under the Consumer Protection Act, 2019 to approach a consumer forum at your place of residence.

Before starting formal proceedings, we ask that you raise the matter with our Grievance Officer (Section 17) so we have a chance to resolve it. Most issues are settled this way.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce a provision is not a waiver of it.

We acknowledge grievances within 48 hours and aim to resolve them within 30 days of receipt.
